There are 2 easy ways to upload your photos for possible selection to the gallery:
If your photo is selected for our gallery via social media, you will receive an Instagram comment or tweet from @porcelanosa. Please reply with #YesPorcelanosa to give your permission, and agree to our Terms and Conditions. Porcelanosa’s privacy policies can be found here.
Due to the large number of submissions via social media, you will only be contacted if your photo has been selected to appear in the gallery. If you choose to upload your photo directly via the Porcelanosa website, you will have given your consent and will not be contacted if selected.
By uploading your photo you acknowledge that it may be selected for display in the gallery on the Websites, Porcelanosa will select photos at its absolute discretion. For the avoidance of doubt, Porcelanosa is under no obligation to use any photos submitted.
By uploading your photo, you retain your rights to that photo. By submitting a photo, you hereby grant Porcelanosa a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, assignable, sublicensable license to use, edit, alter, reproduce, translate, publish, and/or distribute the photos and/or incorporate them into other works on the Porcelanosa website, their collaborators’ or commercial partners’ websites, or in other products or services available through the Websites (the Websites and the products and services collectively referred to as the “Services”) using any and all media or distribution methods (now known or later developed), without the obligation of attribution, except where required by applicable law. If you require attribution under the laws applicable to you, or if you are under a jurisdiction where any rights, including moral rights, are non-waivable, you must expressly notify Porcelanosa at the time of submission. You understand that this license means your photo may be made available by Porcelanosa worldwide on the Services and that other users of the Services (individuals and companies) can also share and make your photos available on social media platforms or other services. More particularly, a user can share a photo directly from the gallery on Pinterest, Twitter, Instagram, Facebook, and WhatsApp. If you do not want to grant the permissions set out above, then please do not submit or share your photos.
By submitting your photos you warrant and represent that you have the right to grant the licence described above. In particular, you promise that you have obtained the permission of all the people featured in the photo (and, if they are under 18 their parents and guardians as well) to allow Porcelanosa and other users of the Services to use the photos. To the extent permitted by law, you also agree to waive your moral rights in relation to any photos submitted.

Depending on how you upload your photos to the gallery, it may provide you with the ability to interact with social media services. These features may enable integration and/or access to your social media services, your profiles on those services or establish rules about how your personal information on those services will be used. You and the social media providers are in control of those issues, not Porcelanosa. Please read all policies and information on the applicable social media services to learn more about how they handle your information before using any such features. We are not responsible for any acts or omissions by any social media service provider or your use of features that come from their platform.
Porcelanosa moderates all photos before they are submitted to the gallery but to help our moderators please keep in mind the following:
You may be whitelisted so that you do not need to manually give Porcelanosa rights approval to each image (via the use of #YesPorcelanosa as explained above). If you want to be included in our whitelist, please fill in the form you will find in the following link: http://cloud.mkt.porcelanosa.com/ugc-whitelist. This way, all images in which you mention us or tag us afterwards will be automatically rights approved.
If you believe a photo on the gallery is inappropriate, offensive or is violating someone’s legal rights (for example, copyright or trademark infringement) then you can report the photo by sending an email to ask@porcelanosa.com.
Please note that whilst Porcelanosa can remove photos from the gallery, the Websites, Services or any other website under Porcelanosa reasonable control, Porcelanosa is not able, nor is Porcelanosa responsible for, the removal of photos shared or posted by third parties on third party sites (including but not limited to social media sites) which are not under Porcelanosa control. If you wish to report a photo shared on a third party site, you should contact the third party or third party site directly.
Porcelanosa will remove any photos and/or content that may put Porcelanosa or our agents at legal risk, such as potentially libellous or defamatory comments, or photos posted in potential breach of copyright or other third party rights. Porcelanosa or its agents reserve the right, in their sole discretion, to remove any photos or comments at any time without specifying the reason(s) for doing so or without entering into further correspondence.
